Section 1.KRS 45A.350 is amended to read as follows:
KRS 45A.345 to 45A.460 shall apply to every local public agency in this state, except that a local public agency may purchase goods produced by convict labor from the bureau of corrections without having to comply with the requirements of the Kentucky procurement code. Any legislative body or governing board may adopt any of the other provisions of this code, and may make modifications of such provisions, provided, however, that such modifications shall not be inconsistent with the Kentucky procurement code.

Section 2. KRS 197.210 is amended to read as follows:
(1) On and after June 17, 1954, all offices, departments, institutions and agencies of this state which are supported in the whole or in part by this state shall purchase, and all Political subdivisions of this state shall (may) purchase, when economically feasible from the bureau of corrections all articles or products required by such offices, departments, institutions, agencies, or political subdivisions of this state, produced or manufactured by prison labor, as provided by KRS 197.200 to 197.250, and no such article or product shall be purchased by any such office, department, institution, or agency, from other source, except as hereinafter provided:
(a) Exceptions may be made in any case where, in the opinion of the department of finance, the articles or products so produced or manufactured do not meet the reasonable requirements of such offices, departments, institutions, agencies, or in any case, where the requisition cannot be reasonably complied with because of an insufficient supply of the articles or products required. However, no office, department, institution, or agency, shall be allowed to evade the intent and meaning of KRS 197.200 to 197.250 by slight variations from standards adopted by the division of purchases, when the articles or products produced or manufactured by the bureau in accordance with said standards, are reasonably adapted to the actual needs of such office, department, institution, or agency.
(2) All purchases, under KRS 197.200 to 197.250 shall be made through the department of finance upon requisition by the proper authority of the office, department, institution, agency or political subdivision of this state.
